NEDERLANDS (ENGLISH BELOW)

 

1. Algemeen

De algemene voorwaarden gelden voor iedere aanbieding, behandeling en transactie tussen Eyebrow Guru en een cliënt waarop Eyebrow Guru  deze voorwaarden van toepassing heeft verklaard, voor zover van deze voorwaarden niet door partijen uitdrukkelijk en schriftelijk is afgeweken.

2. Totstandkoming overeenkomst

1 De overeenkomst tussen Eyebrow Guru en de cliënt komt tot stand nadat de cliënt heeft verzocht om een behandeling en Eyebrow Guru heeft aangegeven deze behandeling uit te zullen voeren.

2 Indien de cliënt Eyebrow Guru mondeling of schriftelijk verzoekt tot een behandeling, komt de overeenkomst pas tot stand op het moment dat Eyebrow Guru de overeenkomst schriftelijk heeft bevestigd. De cliënt zorgt ervoor dat alle gegevens, die redelijkerwijs van belang kunnen zijn voor een goede uitvoering van de behandeling tijdig aan Eyebrow Guru worden verteld.

 

 

3. Inspanningen Eyebrow Guru

1 Eyebrow Guru staat ervoor in dat de uitgevoerde werkzaamheden aan de overeenkomst beantwoorden. Deze overeenkomst kan bestaan uit verschillende behandelingen op het gebied van het stylen van wenkbrauwen.

2 Is het voor de uitvoering van de overeenkomst noodzakelijk dat er apparatuur wordt gebruikt, dan staat Eyebrow Guru er voor in dat deze materialen en middelen deugdelijk zijn.

3 Eyebrow Guru informeert de cliënt zo optimaal mogelijk over de omvang van de behandeling in tijd en geld. Ook zullen eventuele risico’s die verbonden zijn aan de behandeling met cliënt worden besproken.

4 Eyebrow Guru zal zoveel als redelijkerwijs mogelijk is de cliënt inlichten over financiële consequenties van een wijziging of aanvulling van de betreffende behandeling.

5 Eyebrow Guru behoudt zich het recht voor om vragen over de gezondheid van cliënt te stellen indien en voor zover deze relevant zijn voor de behandeling. De cliënt is zich er van bewust dat het verzwijgen van (mogelijk) relevante informatie voor rekening en risico van de cliënt komt.

6 Eyebrow Guru verklaart hierbij uitdrukkelijk geen behandelingen uit te voeren waarvoor Eyebrow Guru niet is opgeleid.

7 Eyebrow Guru zal de behandeling naar beste inzicht en vermogen en overeenkomstig de eisen van goed vakmanschap uitvoeren.

8 Eyebrow Guru verplicht zich te werken volgens de geldende wet- en regelgeving en verplicht zich de optimale stand van de techniek te gebruiken. Om aan dit vereiste te voldoen, volgt Eyebrow Guru cursussen en opleidingen.

 

 

3. Afspraken

1 De cliënt moet verhindering voor een afspraak zo spoedig mogelijk, doch uiterlijk vierentwintig uur voorafgaande aan de afspraak aan Eyebrow Guru melden.

2 Indien de cliënt deze verplichting niet of niet tijdig nakomt, mag Eyebrow Guru het gehele honorarium voor de afgesproken behandeling aan de cliënt door berekenen.

3 Indien de cliënt meer dan vijf minuten later dan de afgesproken tijd in de salon komt mag Eyebrow Guru de verloren tijd inkorten op de behandeling en toch het gehele honorarium van de behandeling aan de cliënt door berekenen.

4 Indien de cliënt bij meer dan vijftien minuten later dan de afgesproken tijd in de salon aankomt, mag Eyebrow Guru de gehele afspraak annuleren en toch het gehele honorarium van de behandeling aan de cliënt door berekenen.

5 Eyebrow Guru moet verhindering voor een afspraak zo spoedig mogelijk, doch uiterlijk vierentwintig uur voorafgaande aan de afspraak aan de cliënt melden.

6 Mocht de cliënt een terecht beroep doen op overmacht, dan zal Eyebrow Guru de kosten voor de betreffende behandeling niet in rekening brengen. Het bewijsrecht voor een overmachtssituatie ligt bij de cliënt en is altijd ter beoordeling van Eyebrow Guru. Bij de beoordeling of er al dan niet sprake is van overmacht wordt aangesloten bij de wettelijke en juridische status van het begrip overmacht: “van overmacht is sprake als het gaat om abnormale en onvoorziene omstandigheden die onafhankelijk zijn van de wil van degene die zich erop beroept en waarvan de gevolgen ondanks alle voorzorgsmaatregelen niet konden worden vermeden”.

 

4. Persoonsgegevens & privacy

1 Eyebrow Guru behandelt de vertrouwelijke gegevens van de cliënt conform de richtlijnen in de AVG.

 

2. Eyebrow Guru zal gegevens van de cliënt niet verkopen of verhuren aan derden zonder schriftelijke toestemming vooraf van de cliënt.

 

5. Betaling

1 Eyebrow Guru vermeldt alle prijzen van de behandelingen duidelijk zichtbaar in de salon.

2 De gemelde prijzen zijn inclusief 21% BTW.

3 Aanbiedingen in advertenties zijn geldig in de aangegeven looptijd en/of zolang de voorraad strekt.

4 Eyebrow Guru vermeldt prijswijzigingen 30 dagen voor de ingangsdatum duidelijk zichtbaar in de salon.

5 De cliënt dient direct na afloop van de behandeling de betaling van de behandeling contant te voldoen.

   6   Bij een afname van een aanbiedingen zoals kaart voor 3 of 5 behandelingen gelden de volgende regels:

• De aanbieding is strikt persoons gebonden

• De aanbieding is niet inwisselbaar voor geld

• De kaart is alleen geldig voor de op de kaart vermelde behandeling

1. Bij het staken van de bedrijfsactiviteiten van Eyebrow Guru zal Eyebrow Guru de cliënt met een strippenkaart daarvan op de hoogte stellen en de niet genoten behandelingen terugbetalen aan de cliënt.

2. Eyebrow Guru behoudt zich het recht voor om bij een reeks van behandelingen de cliënt te verplichten om over te gaan tot een vooruitbetaling van de totaalprijs of een gedeelte daarvan.

3. Indien een reeks van behandelingen zonder geldige reden wordt afgebroken door de cliënt, dan zal Eyebrow Guru zich het recht voorbehouden om de totaalprijs van de reeks behandelingen te factureren.

Indien de reeks van behandelingen wordt gestopt op advies van een medisch specialist, kan in overleg worden gegaan over het gedeeltelijk terug betalen van de totaalprijs, verminderd met de reeds uitgevoerde behandelingen.

6. Geheimhouding

1 Eyebrow Guru is verplicht tot geheimhouding van alle vertrouwelijke informatie die de cliënt heeft mede gedeeld tijdens de behandeling.

2 Informatie geldt als vertrouwelijk als dit door de cliënt is verteld of als dit voortvloeit uit de aard van de informatie.

3 De geheimhouding vervalt indien, op de grond van een wettelijke bepaling of een rechtelijke uitspraak Eyebrow Guru verplicht de vertrouwelijke informatie aan derden te verstrekken.

 

7. Aansprakelijkheid

1 Eyebrow Guru is niet aansprakelijk voor schade van welke aard ook ontstaan doordat Eyebrow Guru is uitgegaan van door de cliënt verstrekte onjuiste en/of onvolledige informatie over lichamelijke aandoeningen en/of medicijngebruik.

2 Eyebrow Guru is niet aansprakelijk voor verlies, diefstal, of beschadiging van persoonlijke eigendommen die de cliënt heeft meegebracht naar de salon.

3 Bij de uitvoering van de overeenkomst is Eyebrow Guru nooit meer aansprakelijk dan dat de bedrijfsaansprakelijkheidsverzekering uitkeert.

 

8. Klachten

1 Indien de cliënt een klacht heeft over de betreffende behandeling, moet de klacht zo spoedig mogelijk, doch binnen twee weken na de behandeling mondeling zowel schriftelijk gemeld worden aan Eyebrow Guru.

2 Eyebrow Guru moet de klager binnen 5 werkdagen adequaat antwoord geven.

3 Indien een klacht over de behandelingen gegrond is zal Eyebrow Guru de behandeling opnieuw verrichten zoals overeengekomen, tenzij dit inmiddels voor de cliënt aantoonbaar zinloos is geworden en de cliënt dit schriftelijk kenbaar maakt.

4 Indien Eyebrow Guru en de klager niet tot overeenstemming kunnen komen, kan de klager het geschil voorleggen aan de wetgever of mediator.

 

9. Garantie

1 Eyebrow Guru geeft de cliënt 7 dagen garantie op de behandeling. Binnen deze 7 dagen dient de cliënt schriftelijk aan Eyebrow Guru  kenbaar te maken dat zij zich wil beroepen op de garantie regeling. Dit garantie houdt in dat de cliënt, indien de behandeling niet het resultaat heeft gehad dat er redelijkerwijs van mag worden verwacht, Eyebrow Guru de behandeling kosteloos opnieuw zal uitvoeren of een correctie zal toepassen.

2 Deze garantie vervalt indien:

• De cliënt andere producten dan door Eyebrow Guru geadviseerde producten heeft gebruikt;

• De cliënt de adviezen voor thuisverzorging niet heeft opgevolgd;

• De cliënt het advies om medische hulp te zoeken niet binnen vijf werkdagen heeft opgevolgd;

• De cliënt de geadviseerde producten niet volgens de gebruiksaanwijzing heeft gebruikt;

• De cliënt zijn/haar wenkbrauwen heeft laten onderhouden door een andere beautysalon.

 

10. Intellectuele eigendom

1 Indien Eyebrow Guru een voorbeeld toont van een aan te brengen ontwerp, dan geldt dit slechts als aanduiding. Het resultaat van de wenkbrauwen van de cliënt hoeft niet identiek te zijn aan het getoonde voorbeeld.

2 Indien de cliënt het uiteindelijke resultaat laat fotograferen voor commercieel gebruik, moet vooraf toestemming gevraagd worden aan Eyebrow Guru. Eyebrow Guru mag hiervoor een redelijke vergoeding eisen.

3. Indien Eyebrow Guru de kennis van haar eigen, ontwikkelde methode Holistic Eyebrow Styling heeft gedeeld met de cliënt en de cliënt deze kennis vervolgens wil delen (al dan niet voor commercieel gebruik), moet vooraf toestemming worden gevraagd aan Eyebrow Guru. Indien Eyebrow Guru toestemming verleent, mag de kennis enkel gedeeld worden met de naamsvermelding van Eyebrow Guru. Tevens mag Eyebrow Guru hiervoor een redelijke vergoeding vragen.

 

11. Beschadiging en/of diefstal

1 Eyebrow Guru heeft het recht van de cliënt een schadevergoeding te eisen, indien de cliënt meubilair, apparatuur of producten binnen de salon of het bedrijf waarin de salon zich bevindt, beschadigt.

2 Eyebrow Guru meldt diefstal altijd bij de politie.

 

12. Behoorlijk gedrag

1 De cliënt behoort zich in de salon te gedragen volgens algemene aanvaarde normen.

2 Indien de cliënt na herhaaldelijke waarschuwingen onbehoorlijk gedrag blijft vertonen, heeft Eyebrow Guru het recht de cliënt de toegang tot de salon te weigeren zonder verdere opgaaf van redenen.

3 Er wordt van de cliënt verwacht dat de aanwijzingen van Eyebrow Guru opvolgen met betrekking tot het beperken van overlast aan klanten en/of derden die zich bevinden in het bedrijf waar de salon is gevestigd.

13. Huisregels

1 In de salon is niet toegestaan om te roken.

2 Het is niet toegestaan om eigen consumpties te nuttigen in de salon.

3 In verband met de gedetailleerde behandelingen is de salon geen plek voor kinderen of (huis)dieren. Deze zijn dan ook niet toegestaan in de salon.

4 Het is de cliënt zonder toestemming vooraf niet toegestaan gasten mee te nemen naar de salon.

5 Voor het stylen van de wenkbrauwen hanteert Eyebrow Guru een minimumleeftijd van 18 jaar.

6 Indien de cliënt jonger is dan 18 jaar dienen/dient de ouders/voogd van de cliënt hun toestemming te hebben verleend voor het stylen van de wenkbrauwen.

 

14. Recht

1 Op elke overeenkomst tussen Eyebrow Guru en de cliënt is het Nederlandse recht van toepassing.

2 De algemene voorwaarden zijn gepubliceerd op de website van Eyebrow Guru en zijn ook in de salon beschikbaar.

3 De algemene voorwaarden zijn gedeponeerd bij de Kamer van Koophandel te Amsterdam. Ze zijn gedeponeerd onder nummer 68972156. U kunt de voorwaarden opvragen bij de Kamer van Koophandel.

4 Ingeval van uitleg van de inhoud en strekking van de algemene voorwaarden, is de Nederlandse tekst daarvan steeds bepalend.

5 Van toepassing is steeds de laatst gepubliceerde versie c.q. de versie zoals die gold ten tijde van het tot stand komen van de overeenkomst.

1. General

The general terms and conditions apply to every offer, treatment and transaction between Eyebrow Guru and a client to which Eyebrow Guru has declared these terms and conditions applicable, insofar as the parties have not explicitly deviated from these terms and conditions in writing.

 

2. Establishment of agreement

1 The agreement between Eyebrow Guru and the client is concluded after the client has requested a treatment and Eyebrow Guru has indicated that it will carry out this treatment.

2 If the client requests Eyebrow Guru orally or in writing for a treatment, the agreement will only be concluded when Eyebrow Guru has confirmed the agreement in writing. The client ensures that all information that may reasonably be important for the proper execution of the treatment is communicated to Eyebrow Guru in a timely manner.

 

3. Efforts Eyebrow Guru

1 Eyebrow Guru guarantees that the work performed meets the agreement. This agreement can consist of different eyebrow styling treatments.

2 If it is necessary for the implementation of the agreement that equipment is used, Eyebrow Guru guarantees that these materials and resources are sound.

3 Eyebrow Guru informs the client as optimally as possible about the scope of the treatment in time and money. Any risks associated with the treatment will also be discussed with the client.

4 Eyebrow Guru will inform the client as much as reasonably possible about the financial consequences of a change or addition to the relevant treatment.

5 Eyebrow Guru reserves the right to ask questions about the health of the client if and insofar as these are relevant to the treatment. The client is aware that the concealment of (possibly) relevant information is at the expense and risk of the client.

6 Eyebrow Guru hereby expressly declares not to perform any treatments for which Eyebrow Guru has not been trained.

7 Eyebrow Guru will perform the treatment to the best of its knowledge and ability and in accordance with the requirements of good craftsmanship.

8 Eyebrow Guru undertakes to work in accordance with applicable laws and regulations and undertakes to use the optimum state of the art. To meet this requirement, Eyebrow Guru takes courses and training.

 

 

3. Appointments

1 The client must report to Eyebrow Guru if they are unable to attend an appointment as soon as possible, but no later than twenty-four hours prior to the appointment.

2 If the client fails to comply with this obligation or fails to do so on time, Eyebrow Guru may charge the entire fee for the agreed treatment to the client.

3 If the client arrives in the salon more than five minutes later than the agreed time, Eyebrow Guru may shorten the time lost on the treatment and still charge the entire fee for the treatment to the client.

4 If the client arrives at the salon more than fifteen minutes later than the agreed time, Eyebrow Guru may cancel the entire appointment and still charge the entire fee for the treatment to the client.

5 Eyebrow Guru must notify the client of the absence of an appointment as soon as possible, but no later than twenty-four hours prior to the appointment.

6 Should the client rightly invoke force majeure, Eyebrow Guru will not charge the costs for the relevant treatment. The right of proof for a force majeure situation lies with the client and is always at the discretion of Eyebrow Guru. In assessing whether or not there is force majeure, the legal and legal status of the concept of force majeure is followed: “force majeure is when it comes to abnormal and unforeseen circumstances that are independent of the will of the person who invokes it and the consequences of which, despite all precautions, could not be avoided”.

 

4. Personal Data & Privacy

1 Eyebrow Guru treats the client's confidential data in accordance with the guidelines in the AVG.

 

2. Eyebrow Guru will not sell or rent client data to third parties without the prior written consent of the client.

 

5. Payment

1 Eyebrow Guru lists all prices of the treatments clearly visible in the salon.

2 The stated prices include 21% VAT.

3 Offers in advertisements are valid for the specified duration and/or while stocks last.

4 Eyebrow Guru clearly states price changes 30 days before the effective date in the salon.

5 The client must pay the payment of the treatment in cash immediately after the end of the treatment.

    6 When purchasing an offer such as a card for 3 or 5 treatments, the following rules apply:

• The offer is strictly personal

• The offer cannot be exchanged for cash

• The card is only valid for the treatment stated on the card

When Eyebrow Guru's business activities are discontinued, Eyebrow Guru will inform the client of this with a strippenkaart and refund the treatments not enjoyed to the client.

Eyebrow Guru reserves the right to oblige the client to make an advance payment of the total price or part thereof for a series of treatments.

If a series of treatments is canceled by the client without a valid reason, Eyebrow Guru will reserve the right to invoice the total price of the series of treatments.

If the series of treatments is stopped on the advice of a medical specialist, consultations can be held about partial reimbursement of the total price, less the treatments already performed.

 

6. Confidentiality

1 Eyebrow Guru is obliged to maintain the confidentiality of all confidential information that the client has shared during the treatment.

2 Information is considered confidential if this has been told by the client or if this follows from the nature of the information.

3 The confidentiality lapses if, on the basis of a legal provision or a court decision, Eyebrow Guru is obliged to provide the confidential information to third parties.

 

7. Liability

1 Eyebrow Guru is not liable for damage of any nature whatsoever caused by Eyebrow Guru relying on incorrect and/or incomplete information provided by the client about physical disorders and/or medication use.

2 Eyebrow Guru is not liable for loss, theft, or damage to personal property that the client has brought to the salon.

3 In the execution of the agreement, Eyebrow Guru is never more liable than the company liability insurance pays out.

 

8. Complaints

1 If the client has a complaint about the treatment in question, the complaint must be reported orally and in writing to Eyebrow Guru as soon as possible, but within two weeks after the treatment.

2 Eyebrow Guru must give the complainant an adequate answer within 5 working days.

3 If a complaint about the treatments is justified, Eyebrow Guru will perform the treatment again as agreed, unless this has become demonstrably pointless for the client and the client makes this known in writing.

4 If Eyebrow Guru and the complainant cannot come to an agreement, the complainant can submit the dispute to the legislator or mediator.

 

9. Warranty

1 Eyebrow Guru gives the client a 7-day guarantee on the treatment. Within these 7 days, the client must inform Eyebrow Guru in writing that she wishes to invoke the guarantee scheme. This guarantee means that if the treatment has not had the result that can reasonably be expected, Eyebrow Guru will perform the treatment again free of charge or apply a correction.

2 This warranty is void if:

• The client has used products other than those recommended by Eyebrow Guru;

• The client has not followed the advice for home care;

• The client has not followed the advice to seek medical help within five working days;

• The client has not used the recommended products according to the instructions for use;

• The client has had his/her eyebrows maintained by another beauty salon.

 

10. Intellectual Property

1 If Eyebrow Guru shows an example of a design to be applied, this is only an indication. The result of the client's eyebrows does not have to be identical to the example shown.

2 If the client has the final result photographed for commercial use, permission must be requested from Eyebrow Guru in advance. Eyebrow Guru may demand a reasonable fee for this.

3. If Eyebrow Guru has shared the knowledge of its own, developed Holistic Eyebrow Styling method with the client and the client subsequently wishes to share this knowledge (whether or not for commercial use), permission must be requested from Eyebrow Guru in advance. If Eyebrow Guru grants permission, the knowledge may only be shared with the attribution of Eyebrow Guru. Eyebrow Guru may also ask for a reasonable fee for this

 

11. Damage and/or theft

1 Eyebrow Guru has the right to claim compensation from the client if the client damages furniture, equipment or products within the salon or the company in which the salon is located.

2 Eyebrow Guru always reports theft to the police.

 

12. Proper Conduct

1 The client should behave in the salon according to generally accepted standards.

2 If the client continues to show improper behaviour after repeated warnings, Eyebrow Guru has the right to refuse the client access to the salon without further explanation.

3 The client is expected to follow Eyebrow Guru's instructions with regard to limiting nuisance to customers and/or third parties who are located in the company where the salon is located.

 

13. House Rules

1 Smoking is not allowed in the salon.

2 It is not allowed to consume your own drinks in the salon.

3 Due to the detailed treatments, the salon is not a place for children or pets. These are therefore not allowed in the salon.

4 The client is not allowed to bring guests to the salon without prior permission.

5 Eyebrow Guru has a minimum age of 18 years for styling the eyebrows.

6 If the client is younger than 18 years, the parents/guardian of the client must have given their permission for styling the eyebrows.

 

14. Law

1 Dutch law applies to every agreement between Eyebrow Guru and the client.

2 The terms and conditions are published on the Eyebrow Guru website and are also available in the salon.

3 The general terms and conditions have been filed with the Chamber of Commerce in Amsterdam. They have been filed under number 68972156. You can request the conditions from the Chamber of Commerce.

4 In the event of an explanation of the content and purport of the general terms and conditions, the Dutch text thereof is always decisive.

5 The most recently published version or the version that applied at the time of the conclusion of the agreement always applies.
